Booking Terms and Conditions - please read carefully

Holiday confirmation and payment

Upon the Property Owner issuing a holiday confirmation form for the property to the Holidaymaker a binding contract shall exist between the Holidaymaker and the Property Owner subject to these booking conditions:

1. A holiday confirmation form will be issued to the Holidaymaker upon receipt by the Property Owner of a completed holiday booking form or telephone booking, together with a deposit in respect of 40% of the total rental charge.

2. The balance of the rental charge shall be paid to the Property Owner 4 weeks (28 days) prior of the commencement of the holiday (the due date is stated clearly in the holiday confirmation form sent to the Holidaymaker). In the event that the holiday start date should be 4 weeks or less from the date of booking, the full rental charge is due.

3. Where the Property Owner has not received the balance by the due date an overdue reminder letter will be issued to the Holidaymaker and a charge of £10 will be added to the balance due. If the balance is still not received the Property Owner reserves the right to cancel the holiday booking and to retain as forfeit the deposit paid by the Holidaymaker and the Holidaymaker shall have no claim against the Property Owner for compensation or reimbursement.

4. Payment may be made in two ways: either by credit card using PAYPAL or by personal cheques made payable to: L J FREEMAN. Holidaymakers wishing to pay using PAYPAL should advise us so that we may e-mail you an appropriate invoice.

Changes by the holidaymaker

Immediately upon receipt of the holiday confirmation from the Property Owner, the Holidaymaker should check the details and notify the Property Owner immediately of any correction as soon as possible.

The Property Owner reserves the right to charge a holiday booking amendment fee in such circumstances.

Cancellation by the holidaymaker

1. The Holidaymaker should notify the Property Owner immediately and in writing of any intention to cancel the holiday booking. The cancellation only takes effect when the Property Owner has received written confirmation from the Holidaymaker.

2. If the Property Owner is unable to relet the holiday accommodation for the period of the cancelled holiday, all monies paid by the Holidaymaker to the Property Owner shall be forfeited to the Property Owner.

3. If the holiday accommodation is relet, monies received by the Property Owner for the relet holiday will be refunded to the Holidaymaker, less a handling charge of £45 per week. (please note: Refunds will not be made until after the relet holiday has taken place)

4. Holiday cancellation insurance is not provided by the Property Owner and is not included in the price of the holiday.

Cancellation or changes by the property owner

In the event of the Property Owner being unable to arrange or is forced to cancel the holiday accommodation the Property Owner shall refund all monies received in full to the Holidaymaker.

Responsibilities of the holidaymaker

During the period of the holiday the Holidaymaker undertakes the following:

1. That the number of people occupying the property will not exceed the number stated on the booking form. If not, the Property Owner or their representative can refuse to allow the Holidaymaker to take possession of the property or make the Holidaymaker leave the accommodation before the end of the holiday. If this happens the Property Owner shall treat the holiday as being cancelled by the Holidaymaker and the Holidaymaker shall have no claim against the Property Owner for compensation or reimbursement whatsoever.

2. That the property will be used solely for the purpose of a holiday by the Holidaymaker and his/her party.

3. To show due consideration for other parties. If the Holidaymaker abuses the property or displays dangerous, offensive or rude behaviour to the Property Owner their representatives or any third parties (e.g.neighbours), the Property Owner or their representative has the right to ask the Holidaymaker to leave the accommodation before the end of the holiday. If this happens the Property Owner shall treat the holiday as being cancelled by the Holidaymaker and the Holidaymaker shall have no claim against the Property Owner for compensation or reimbursement whatsoever.

4. To allow the Property Owner or their representative access to the property at any reasonable time during the period of the holiday.

5. To keep the property and all the furniture, utensils, equipment, fixtures and fittings in and on the property in the same state of repair and condition as at the commencement of the holiday and to ensure that at the end of the holiday the property is left in the same state of order and cleanliness in which it was found. The Property Owner reserves the right to levy an additional charge for any extra exceptional cleaning required after the Holidaymaker’s occupancy.

6. To report as soon as possible to the Property Owner any breakages or damage caused by the Holidaymaker during the holiday and to reimburse the Property Owner with the cost of replacement. The Property Owner reserves the right to make a claim against the Holidaymaker for repair or loss as a result of damage caused.

7. To notify all other members of the Holidaymaker’s party of the Terms & Conditions.

8. To arrive after 3.00 p.m. (1500hrs) on the arrival day and to vacate the property by 10 a.m. (1000hrs) on the day of departure unless another arrangement has been agreed with the Property Owner.

Children

Young children under the age of 5 years are not accepted. If a Holidaymaker brings a young child less than 5 years of age the Property Owner or their representative can refuse to allow the Holidaymaker to take possession of the property or make the Holidaymaker leave the accommodation before the end of the holiday.

If this happens the Property Owner shall treat the holiday as being cancelled by the Holidaymaker and the Holidaymaker shall have no claim against the Property Owner for compensation or reimbursement whatsoever.

Pets

Pets are not allowed. If a Holidaymaker brings a pet the Property Owner or their representative can refuse to allow the Holidaymaker to take possession of the property or make the Holidaymaker leave the accommodation before the end of the holiday. If this happens the Property Owner shall treat the holiday as being cancelled by the Holidaymaker and the Holidaymaker shall have no claim against the Property Owner for compensation or reimbursement whatsoever. Exception: Assistance Dogs (i.e. Guide Dogs) are welcomed.

Smoking

Smoking is not allowed within the Holiday Property or the grounds.

If a Holidaymaker or any of the Holiday Maker’s party smoke within the property or the grounds the Property Owner or their representative can refuse to allow the Holidaymaker to take possession of the property or make the Holidaymaker leave the accommodation before the end of the holiday.

If this happens the Property Owner shall treat the holiday as being cancelled by the Holidaymaker and the Holidaymaker shall have no claim against the Property Owner for compensation or reimbursement whatsoever.

Other

The Property Owner shall accept no liability to the Holidaymaker for any loss, damage or injury howsoever caused to the Holidaymaker, the Holidaymaker’s party or the Holidaymaker’s personal property.

These terms and conditions form part of the booking acceptance by the Holidaymaker.
